Landlord Won’t Return $2000 Deposit Or Prorated Rent And He’s Going Into Foreclosure? What Are My Options?

The condo I leased is in Nevada. I now live in Colorado. Landlord has bluntly stated he’s not giving the deposit or prorated rent back via email and has not given us an itemized list stating why? Its been over 30 days since we moved. Can I do anything from out of state (small claims, lien, anything else??) to get my money back?

  1. TAKE HIM TO COURT AND SUE PUT A LEAN AGAINST ANYTHING HE OWNS SO IF HE SELLS IT YOU HAVE RIGHTS TO THE MONEY BEFORE HIM OR THECOURT CAN TELL HIM HE MUST SELL THE ITEMS TO PAY YOU SUCH AS A CAR

  2. I suggest getting a lawyer.
    If all else fails, get the public in on it. Tell newspapers, go to the “problem solvers”, raise he**. Bad reputaion is a powerful tool my friend.
    But I suggest checking all the legal options first. Definatly think about that lawyer!

  3. Yep. You’ve got to sue him. Problem is, you won’t be on the top of the list of how any money he has is doled out. You will probably be on the bottom, creditors first.
    See what a lawyer wants to charge…
    sorry things look bad in this case.

  4. You could go to small claims court, but If he is going into foreclosure, he is out of money. So lots of luck.

  5. The one main question is, Did you break the lease? If so, it may be you who is going to be sued.
