Thank you!!!!!!!!!!!!!!!!!!!!!!!!!

Buying a house with tenants? what are my rights?

I’m buying a house in Georgia which has an existing tenant on a 12-month lease. The house is not a foreclosure and I am buying using a FHA loan, as I intend to live in the house as my primary residence. What are my legal rights in terms of taking possession of the house.

About bankruptcy in Georgia- know some about ch 7&13, but need to know- if you file and it stops a -?

foreclosure sale of the primary residence, can you decide not to follow through with the foreclosure after it goes in front of the judge, say if you don’t think that you can do the repayment plan. I am trying to delay a sale of a house until I can move or find a buyer to payoff the mortgage, but I don’t want to ruin my credit by bankruptcy and dont think I could do a repayment plan that would satisfy them and dont really want to liquidate all. Thanks. Any info would help. Also, some lawyers have contacted me and said they could do same day electronic filing, but I dont know if in Georgia you have to take a credit counseling class first. Can I just file?

Can a bank refuse to look at an offer on a bank-owned foreclosure?

A friend of mine has tried to submit an offer on a home that is bank owned. The bank has accepted an offer already, but my friend would like to submit a back up contract. The agent working with the bank has said that he will not submit any other offers as a back up because the bank does not have to look at any additional offers made once they have an accepted contract. Is this true? The property is in Georgia.
There is currently an accepted contract on this property. I know that on property that is owned by an individual, the agent has to present ALL offers even if there is already an accepted contract. So I am just trying to find out if when a property is bank owned, the agent is exempt from having to present any other offers?
Thanks to everyone who gave informative information. I just spoke with an agent who works with Wells Fargo on their foreclosed properties. He says that it is Wells Fargo’s policy that if they have an accepted contract, they will not consider any other offers because they are "proceeding ahead with a positive attitude that the deal will close successfully". I, personally think it would be in their best interest to have a back up contract, but I guess due to the extra paper work a back up contract would create, they would rather not fool with it.

bankruptcy in state of georgia-?

if you file ch 7 or 13 to avoid foreclosure and postpone property sale, can you stop the bankruptcy proceedings at the hearing-say if the repayment was not feasible. I am trying to buy time to move. Thanks

bankruptcy in Georgia- need to know-?

If you file ch 7 or 13 to stop a foreclosure sale, can you stop the bankruptcy petition at a later date if for example the repayment is not feasible, and still just delay the sale of the property (primary residence)? Also, if you do file and own half of another property in another state (FL) equally with another relative and it is your father’s life estate (not ownership), will that property be affected at any time by the bankruptcy filing (the other house is worth quite a bit)? Thanks

After a home is auctioned in a foreclosure sale at the courthouse in the state if Georgia, how long do you-?

have to vacate and remove belongings. It is a primary residence and also a horse farm and have pets. Thanks.

buying an REO in Georgia HELP?

OMG I am seriously stressed out! I found a house on yahoo real estate under the foreclosure section and I LOVE the house. Now it did not give the address of course but I put the address into another site I use and compared that info with each house on the street and found a perfect match so I’m sure I have the correct address. BUT its a REO! I drove by the house yesterday, there is not a sign in the yard. Does there have to be?

I can not seem to find anyone who can help me, I am waiting on a real estate agent to call me back tonight. I have called the county court house because I just want to double check and see if for sure that address is being foreclosed on and no one can help me they told me all I can do is look at the listings in the daily journal. Does that make sense. I haven’t slept all night and have been working on this all day and I am about on the verge of tears, can some one please tell me what to do?
Looked up the address on the county assessor site and it looks like they are with wells fargo, can I just contact wells fargo about it? I am so scared that every second that goes by I’m closer to losing the house.

Then in the back of my mind I am wondering how reliable is yahoo real estate? anyone know?
